AeroForester Terms of Service
INTRODUCTION
Welcome to AeroForester Cloud, a cloud-based geospatial and AI-driven platform designed for forestry applications. Unless otherwise specified, all references to AeroForester include the website at www.AeroForester.com, the AeroForester software, and related services, content, or data.
These Terms of Service (the “AGREEMENT”) are a legal contract between you, the licensee (“you” or “your”), and AeroTract LLC, the owner, developer, and operator of AeroForester, including its employees, officers, and agents (“we,” “us,” or “our”). By accessing or using AeroForester, you agree to be bound by this AGREEMENT without modification. Please read carefully and retain a copy for your records.
PRIVACY
Your use of AeroForester is also governed by our Privacy Policy, which can be found on our website. Please review the Privacy Policy as it explains how we collect, use, and safeguard data.
ELECTRONIC COMMUNICATIONS
By using AeroForester or communicating with us electronically, you consent to receive messages from us electronically, whether via email, notices on the platform, or other digital methods. You agree that such electronic communications satisfy any legal requirement that communications be in writing.
ACCOUNT RESPONSIBILITY
When you create an account with AeroForester, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree not to transfer your account to another party or allow unauthorized access. We are not liable for losses resulting from stolen or misused account credentials. We reserve the right to suspend or terminate accounts, refuse service, or remove content at our discretion.
THIRD-PARTY LINKS & SERVICES
AeroForester may include links to external websites or services operated by third parties. These linked sites are not under our control, and we are not responsible for their content, policies, or practices. Such links are provided as a convenience and do not imply endorsement. Certain services offered through AeroForester may also be provided in partnership with third parties, and by using those features, you consent to limited data sharing as necessary to deliver those services.
ACCEPTABLE USE & INTELLECTUAL PROPERTY
You are granted a limited, non-exclusive, revocable license to use AeroForester in accordance with this AGREEMENT. You agree not to use AeroForester for unlawful purposes or in ways that could harm, disable, or interfere with the platform. You may not attempt to gain unauthorized access to AeroForester, its data, or its underlying systems.
All intellectual property related to AeroForester, including software, databases, documentation, and content, remains the property of AeroTract LLC. You may not copy, modify, reverse-engineer, decompile, or create derivative works from AeroForester without express written consent.
TRANSFER & USE RESTRICTIONS
Without prior written approval, you may not assign, sublicense, lease, resell, or otherwise transfer your rights under this AGREEMENT. You may not attempt to extract, replicate, or distribute the database portions of AeroForester beyond their intended use within the platform.
INTERNATIONAL ACCESS
AeroForester is operated from the United States. If you access the platform from outside the U.S., you are solely responsible for complying with local laws and regulations. You may not use AeroForester in any jurisdiction where such use would be unlawful.
WARRANTY DISCLAIMER
AeroForester is provided “as is” and “as available.” We make no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the platform will meet your specific needs, operate without interruption, or be free from errors or security vulnerabilities.
You assume full responsibility for ensuring AeroForester meets your requirements. We are not responsible for any loss of data, downtime, or damages resulting from use of the platform.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruptions, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for access to AeroForester during the twelve (12) months preceding the claim.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AeroTract LLC, its officers, employees, and agents from and against any claims, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your use of AeroForester, your violation of this AGREEMENT, or your infringement of any third-party rights.
TERMINATION & SEVERABILITY
We may suspend or terminate your access to AeroForester at any time, without notice, for conduct that we believe violates this AGREEMENT or is otherwise harmful to us or other users. If any part of this AGREEMENT is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
CHANGES TO TERMS
We reserve the right to update or modify this AGREEMENT at any time. If significant changes occur, we will notify you via email, on the platform, or through other appropriate means. Continued use of AeroForester after changes take effect constitutes your acceptance of the updated AGREEMENT.
GOVERNING LAW
This AGREEMENT shall be governed by and construed under the laws of the State of Oregon, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Oregon for any disputes arising from or relating to this AGREEMENT or your use of AeroForester.
